The judicialization of health is the construction of a right of society, but it should be fair and conscious, since the plaintiffs will not be prevented from pleading judicially what they believe to be of right, nor will be exhausted the procedural means as a tool for achieving the desired right. The gap and omission of the legislative and executive powers in relation to health, obligatorily force the judiciary to take a position on the subject and decide on health measures. The proposal of this work is the creation of a system of control and supervision of the inputs granted by judicial means. To this research was applied the exploratory methodology that resulted in the creation of protocols that together form the SICOFINJUD.
