The following paper will provide a brief introduction to the historical context of indigenous peoples and the oppression and discrimination they have suffered throughout history. In recent years, their rights have been recognized by laws and international conventions and by the Constitution of the Republic. With this small preamble, Chapter I will give a general overview of the procedure, application and different sanctions that are imposed within the indigenous justice system, which is based on customary law, ancestral traditions, and the meaning that these sanctions have within the ancestral cosmovision. Finally, in chapter II, an analysis will be made on the sentence N. 113-14-SEP-CC ]La Cocha II] and the question will be answered: is the sentence a limitation for the indigenous justice?
